1. Eligibility and approval
The program is available only to registered businesses and legal entities able to issue a valid invoice to Evara. Applications require review. Evara may request verification, reject an application, suspend participation, or close an account. No referral capability exists before approval.
2. Independent business relationship
A partner participates as an independent business, not as an employee, worker, agent, sales representative, or person authorized to bind Evara. Each partner remains responsible for its business, invoicing, taxes, VAT treatment, and legal obligations.
3. Promotion rules
Partners may make truthful, non-misleading recommendations. Spam, impersonation, false claims, guaranteed-earnings claims, bidding on or misusing Evara identity, self-referrals, bulk cold-contact uploads, and unlawful contact sharing are prohibited.
4. Attribution
The first valid partner referral is normally preserved for 30 days. Existing leads and clients are not automatically newly attributable. One lead or client may belong to only one partner. Duplicate, ambiguous, reassigned, or suspected self-referrals require manual review. Evara may correct attribution with an audited reason.
5. Commission and qualifying clients
The current default rate is 10% of eligible collected net one-time website-project revenue. A referral qualifies only after the complete configured project payment is confirmed and the review window passes. Monthly subscriptions, VAT, refunds, chargebacks, fees, taxes, credits, complimentary work, pass-through costs, disputed or unpaid amounts, cancelled work, and non-eligible add-ons are excluded.
6. Refunds and reversals
Before payout, affected commission may be reduced or cancelled. After payout, Evara records a negative adjustment or recovery balance rather than rewriting historical paid records. Duplicate or fraudulent commission is not payable.
7. Statements, invoices and payment
A monthly Commission Statement summarizes approved commission. It is not an invoice or tax document. The partner must issue a valid invoice to Evara for the approved amount. An uploaded invoice is reviewed and is not payable until approved. V1 payments are manual bank transfers recorded by an authorized Evara administrator. No payment date or earnings amount is guaranteed.
8. VAT and tax
Commission is provisionally treated as a net service fee. Applicable VAT is handled on the partner invoice according to the partner's VAT status. Partners must obtain their own accounting or legal advice. This clause requires confirmation by Evara's accountant before operational launch.
9. Suspension and termination
Evara may suspend or terminate participation for inaccurate details, prohibited promotion, abuse, fraud indicators, legal or security risk, or program closure. A reason is recorded. Valid accrued amounts remain subject to review, exclusions, invoice approval, and adjustment rules.
10. Data protection and retention
Partner, referral-contact, attribution, invoice, payout, and audit data is processed as described in the Privacy Policy. Partners must share contact details only where the contact expects the introduction or another lawful basis exists. Financial and audit records may be retained where required by law; unresolved retention periods require legal and accountant confirmation.
11. Program changes, disputes and guarantees
Evara may change future program rules and rates by publishing a new version. Historical commission retains the rule version applied when calculated. No volume, conversion, earnings, uptime, or continued availability is guaranteed. Slovenian law and competent Slovenian courts apply, subject to mandatory law. Liability wording and dispute provisions require lawyer review.
